can an ex spouse place a les pendens on a family trust to retrieve divorce settlement?

My brothers ex wife is trying to place a les pendens against my fathers house to get a portion of his inheritance. My fathers house is free and clear and in a trust. She is already getting 1/2 of his retirement and was suppose to get more money from their home but the house was lost in foreclosure after the divorce was final and she can not collect on her judgment.

Anyone out there have an answer on this? It was brought to my attention what was going on and I don’t know what to do as my dad is 83 years old and very upset over this.

My suggestion is to rule on title in most states you cannot be done it might relieve your dad of anxiety.

No Way, I don’t think she would be entitled to any inheritance. He or his Father need to contact an attorney ASAP to protect there finances. xox
