My Aunt is 90 and her memory is not good. Her attorney told her she was legally allowed to now change her Trust, since her only son passed away. The attorney NEVER contacted the ‘next’ person responsible for her Trust, and put himself in charge. Is this legal/ethical? She allowed it, but she had no one to protect her. Does the family have any recourse?? Again, she’s 90, almost 91. Thanks!

Are there any specific reasons why that would happen? And should I trust that the attorney is telling the truth?

I currently have beneficiary’s setup on my retirement accounts, but I want to know what is the best legal document to complete to make sure the rest of my assets are sent to my family.

He never allowed me to speak or even read the document at the hearing. Obviously, he is a corrupt as the Ace of Spades is different in a deck of cards. By the way, “family” court in California is an absolute mockery of our Constitution and it needs serious reformation. It’s no wonder we have so many “domestic” problems in our society. There is obviously “zero” basis of judgement in the family court system. It is a shame……

The testator has died, the wife is still living, the testator made his oldest daughter the executer, the wife wants to change some things because of the testator leaving the middle child out of most everything, so, there is the testators trust for business and then on for family, but at the present doesn’t she own it all (the wife) so doesn’t she have the right to change things. They are telling her she (the wife) has no rights what so ever even though she has to sign all papers conserning business or other wise, she can’t even leave a set of dish’s to her sister when she dies because it goes into the family trust, so she would have to give them to her now or sell them to her, there has to be a loop hole or something to where she can set things right the way she would like to. HELP

What if the recipient family members signs an agreement to carry out with the disposition and is given the assets to dispose of? Would it be considered a valid, inter vivos trust?

My Father is ill and has done his living trust but has expressed concerns about it. My brother and I are both on the living trust and he is afraid he will hide money, etc. Both of us are on the living trust as executors.

My Father put the living trust in a family trust and specified all money to be distributed between my brother and I. My Father set a separate account for just me in case my brother hides funds. My Father told the bank that I be listed as the beneficiary of this one account if something happens to him. This one account is not listed in the trust.

The question is will that be a problem if something happens to my Father. Will I have access to the money with just the death certificate given the account is listed at the bank to go to me if something happens? Or will the money go to the government, probate or could be contested by my brother? Does my Father need to list this account also in the living trust?
