Dean Burton asked:
Of all the dog breeds available to choose between, parents need to take all considerations into account when they are choosing a pet for their family needs. Don’t just choose a pet based on what you want or let price or convienience be a determining factor for choosing the pet you get. All breeds have their own traits and characteristics that are unique to their group; i.e. the herding group has instincts for chassing and gathering, and the hunting group has instincts to hunt for instance the bird dog has point and retrieve instincts. Use the unlimited resources of the internet, books and don’t forget about your veterinarian to gather info so you can make a smart and decisful decision on which breed will fit your family lifestyle and needs best. Below are a few breed suggestions I have compiled that I think make great pets for families.
Bulldog- Usually a great breed for the family in the North do to the heat can restrict play outdoors; they do well with all ages of children and other pets. They love to be part of the family and enjoy all the attention they can get. Beagle – Despite a Beagle’s hawl/bark, they are usually non-aggressive. They are great around people and other pets, but they don’t like being left alone. Boredom can lead to behavior problems if left alone for too long. They are very active and love to run off energy with the kids, but they are hunters, so running away can be a problem. Cairn Terrier – They are great for families that prefer a smaller dog. Cairns are about 10 inches tall and weigh about 13 pounds and are good with children and other pets. German Shepherd – This dog is good with older children. They are playful and loyal dogs with considerable size and strength. Begin obedience training early because without training they can become quit a handful for you and small children. Poodle – This breed comes in three sizes. Standard, Minature, and Toy. Most people keep them groomed regularly to keep a neat appearance. Research each size to determine which would suite you better. Also popular is the designer breed; the Labradoodle. Labradoodles are a mix of Poodle and Labrador Retriever. They can be a great alternative to a Lab because children with allergies to pet dander usually can tollerate Labradooles do to them being considered a hypoallergenic breed. Collie- Collies are the American icon thanks to the dog “Lassie”. This breed is very well rounded for the family. They are intelligent and train eaisly. They have to be part of the family, or they can get bordom habbits. They make playful companions for the children. Basset Hound – This breed is good with children of all ages. They are known for their gentleness and kind demenour. They are in the hound group, so they can be noisy. Their long backs can be injured if too rambouncious or a child can accidently injure them. Labrador Retriever – Labs are a very popular family dog due to it’s playful, energetic and easygoing demeanor. Generally this breed is non-aggressive, gets along with other family pets, and loves to play all day and swim as well. Pug – This affectionate breed loves being part of the family. Outgoing and mischievous, they make playful companions for children. Golden Retriever – Similar to the Lab in personality, Goldens are mild mannered and enjoy being around families and other people. These dogs are easy to train are gentle with children. They do have a coat that needs attention from time to time. Cocker Spaniel – This breed thinks and loves to be a lap dog. They are sensitive and sweet and enjoy the attention of all who will pet them, especially children. They are obedient when trained and friendly around people and other pets. Regular grooming is needed to keep a healthy coat.
Allthough this list is not a full comprehensive list of which breed would be best for a family, your research may find other breeds of which you could include in your list to research and ask questions about. There are houndreds of dog breeds and designer dog breeds to choose from. This list just captures some of the popular breeds that are chosen to be part of the family. Each dog is an individual and can be an exception to the general breed rules. With that in mind, here are a few breeds to be more cautious of around young children and toddlers.
Dominant and Willful Breeds – Rottweilers, Chow Chows, Coonhounds, Border Collies and Weimaraners all have personalities that make them more difficult to train and trust with a young child. These dogs may function better in homes with older children. Toy Dog Breeds – Young children may play too roughly with the smaller breeds such as Shih Tzus, Chihuahuas and other breeds that are under 10 pounds. These breeds can sustain leg injuries and other serious injury due to being steped on or fallen on. Small breeds can also be more temperamental and “one owner” dogs which make them more apt to snap at children.

Richard Reichmann asked:
Trusts have been used for hundreds of years for tax savings and estate planning, but few people realize the enormous potential for using trusts for privacy.
In this information age where records of your assets can be accessed via computer, fax and even telephone, you have to take active steps to protect your privacy.
A trust is a private contractual arrangement between several parties for holding, managing and investing assets. The parties to the trust are the grantor (the person creating the trust, also known as the “settlor”or “trustor”), the trustee (the person or entity holding title to the assets) and the beneficiaries (for whose benefit the trust is established). A trust created for one’s benefit is called a “self-settled” trust, i.e., one in which the creator and beneficiary are the same person.
A trust created during the life of the grantor is called an “intervivos” or “living” trust. An intervivos trust can be either revocable (taken back or modified by the grantor) or irrevocable (once created cannot be revoked).
A “living trust,” while technically any trust created during the life of the grantor is a buzzword in the estate planning industry used to describe a revocable, intervivos trust.
The typical living trust is created by an individual for his own benefit. He also names himself as trustee, i.e., “The John Doe Family Living Trust.” Upon his death, a successor trustee is named to hold and manage the trust property (typically his spouse, sibling or a bank trust department).
Although he is the beneficiary during his life, the trust will name his family as alternate beneficiary upon his death (known as a “testamentary disposition”).
One of the main reasons why living trusts are used is to avoid probate. Upon your demise, the assets remaining in your estate are distributed according to the instructions of a Will, or, if there is no Will, according to the rules set forth by state law.
The Probate court is involved throughout the process, adding time, cost and aggravation. The Will is now public record, for all the world to see. If you own assets in multiple states, an “ancillary” proceeding must be commenced in each state.
If most of your assets are owned in trust, these assets are not subject to probate, nor are they on display for the world to see.
The trustee, according to the instructions of the trust agreement, either distributes the assets outright to your heirs (the alternate beneficiaries), or holds them in trust until they reach a certain age. Your trust can hold assets (such as real estate) in multiple states without the need for ancillary probate.
You wouldn’t walk around with a financial statement taped to your forehead would you? So why would you have your most valuable assets exposed to public scrutiny? Owning real estate in your own name is like walking around with a giant kick me sign taped to your back.
In every county in the United States, copies of deeds to real estate are recorded in the public records. Anyone can go down to the courthouse or recorder’s office and look up the owner of any property in the county.
A land trust, a modified form of living trust, will hide your name from the public records. The land trust (also known as an Illinois Land Trust, “Title Holding Trust” and “Nominee Trust”) differs slightly from a regular living trust in that the trustee is a mere nominee. The beneficiaries have the right to direct the trustee as to the acquisition, management and disposition of trust property.
The main purpose for using land trusts is privacy of ownership. No one will know who owns the property but you, your attorney and the trustee.
If the trustee resides in a different state than the property is located, it will be difficult, if not impossible, for anyone to discover the proverbial “man behind the curtain.” If a judgment is entered against you, the lien will not automatically attach to the property, since the title is not in your name.
A personal property trust, like a land trust, is a simple, revocable trust used to hold title to assets. Cars, boats, bank accounts, leases, mortgages, mobile homes, corporate stock – you name it – it can all be held in the name of a nominee.
Anything that can be found on public record is a dead giveaway to potential creditors, contingency-fee attorneys and deadbeat litigants looking to steal your hard-earned fortune. Using a nominee trust to hold title to assets will help keep your financial matters private and discreet in the information age.
A trust, unlike a corporation, is not registered with the state. There are no public records of officers, directors and shareholders.
There are no minutes of directors’ and shareholders’ meetings. The trustee keeps control of the trust records and the identity of the beneficiaries in his file cabinet. A trustee will not reveal this information without a court order.
Revocable, living trusts are “tax neutral,” that is, there is no tax consequence of transferring property into trust. According to sections 671- 678 of the Internal Revenue Code, the property is treated as still being owned by the grantor (the logic is that since the grantor can still revoke the trust, it still belongs to him for tax purposes).
For example, if you owned you rental property in your name and reported on schedule “E” of your federal income tax return, a transfer into a revocable, living trust of which you are the beneficiary would not change your reporting.
Compare this to transferring property into a corporation, which is a separate taxpayer, even if your own all of the stock of the corporation.
As you can see, trusts are simple, yet effective devices for holding title to assets and presrving your privacy.

Bob Taylor asked:
For the best family health choose a family doctor.
By choosing a family doctor to care for the family health a person is creating a lasting relationship. By using one doctor, health situations are more easy to control. If one family member becomes ill and the others then come down with the same thing doctor visits can be cut down. Additionally, by having the whole family health history, the doctor will have everything he needs should a medical situation arise.
Every member of the family needs to have a yearly check up just make sure they are healthy. A family doctor will also offer preventative care to help prevent family members from becoming sick or otherwise unhealthy.
The family doctor a person chooses should be someone they are comfortable with and with whom they feel offers the best care. The relationship between a family doctor and the family should be one of trust since it will be a life long relationship.
For the best family health it helps to have a family doctor. A family doctor is a general practitioner who takes care of every family member. By having one general doctor for everyone a family has all their medical history and records with one doctor, instead of spread about at different doctors.
Family health doctor has the skills and training to handle every member of the family, regardless of their age. They can handle a variety of health conditions and will make referrals to specialists if needed. Even if nobody in the family has major health issues having a family doctor is a good thing.

Patricia Woloch asked:
Though not directly exposed to asbestos in high concentrations, family and friends of workers who are heavily exposed are at some risk, as evidence shows. This contamination can come from the clothing of a someone who works with asbestos, living near an asbestos mine, plant or other location, breathing the air in those locations where asbestos exists is large quantities, drinking liquids that have been exposed to asbestos, eating foods grown in dirt or otherwise ingesting dirt that has been exposed to asbestos. Ultimately, exposing your family and friends to asbestos might cause one or more of them to develop mesothelioma many years later.
Exposure of Children
Asbestos fibers can be found in dirt and water supplies near workplaces that mine asbestos or use it extensively in industry. Children are known to drink more fluid per body size, and eat more dirt than adults. Children may ingest dirt by eating it directly, eating foods with dirty hands, or eating food that was dropped on the ground. Children’s lung structure is different than adults, and their fragile respiratory and digestive systems may be more susceptible to inhaled or ingested asbestos particles than an adult’s. Since mesothelioma does not show up until many years after the first exposure, 20 to 50 years by most estimates, it is difficult to estimate whether children are at greater risk than adults, though it is reasonable to consider this possibility.
Resources, Income and Health Care Benefits
If you become unable to work before reaching retirement age, you and your family will suffer the loss of your income and health benefits. Treatment for mesothelioma is expensive, so, even if you qualify for social security disability (SSD) and Medicare coverage, you will go many months, possibly years without income or Medicare coverage before your social security disability is approved, and another 25 months before you are eligible for Medicare.
If your social security disability application is approved, your income will be less than half what you are accustomed to earning, and Medicare does not cover all costs. You will have to pay insurance premiums for Medicare part A, B, (or C) and D, further reducing your usable income.
If you have not worked 40 quarters by the time you become disabled, you will not qualify for social security disability, but might qualify for supplemental security disability insurance (SSDI), and state Medicaid. SSDI is a significantly smaller income than SSD, and Medicaid is usually more limited medical coverage than Medicare, though there is no premium.
Quality of Life and Relationships
In addition to exposing family and friends to contamination from which they might later suffer health consequences, their lives, as well as these relationships, will be affected by your illness.
• If your wife was not formerly employed, she may need to go to work
• She will not be as available to care for you
• If your wife was already working, your income will be reduced to what she can bring in
• You are likely to have medical expenses that are not covered, even by Medicare
• You may need additional help with activities of daily living, such as dressing, fixing meals, taking medications, picking up prescriptions, traveling to the doctor, and more
• You may not be able to play with your children or grandchildren, or enjoy the company of friends and family as others your age might do
• You may find that fewer of them visit for social reasons
• Many friends, as well as some family members, will drift away, not knowing how to relate to you anymore
If you are fortunate enough to have good friends, they will likely be willing to help you, but your relationships will change along with your activities. Mesothelioma will cause your life will change in every way possible.

Linda Dipman asked:
The conquest of the Israelites spread like a lightning bolt. All the countries that lived within the boundaries of the Promised Land were in utter fear for their lives. Kings who had strong fortified cities within massive stone walls trembled as the stories flooded in telling them how easily Israel fought and defeated everyone in their path.
Kings everywhere came together in a united effort to stop God’s people from entering into their country. Instead their defiance of God’s will was met with utter devastation. No one could stand up to the power behind the Israelite army.
Israel held tightly to the Laws of Moses doing everything commanded. Because of each man’s faithfulness a supernatural ability took over each fighting soldier giving them the ability to stand and defeat a thousand men.
Leviticus 26:7&8, “You will be victorious over your enemies; five of you will be able to defeat a hundred, and a hundred will be able to defeat ten thousand.”
Every promise in the Law was fulfilled because the Israelites made a conscious effort to remember the Laws and apply them to their lives. Their faithfulness to God’s words empowered the Spiritual forces of the unseen heavenly kingdom and the Spirits of God ran to protect every soldier from harm while enabling them to defeat every person who tried to come up against them.
Hebrews 1: 14, “What are the angels, then? They are spirits who serve God and are sent by him to help those who are to receive salvation.”
Conquering the Promised Land was an easy task and celebrated as each family became more and more wealthy from their quest. They took over cities and towns filled with beautiful homes. They divided up already sown fields and ripe vineyards. They ate of the land and became content from all of its vast wealth.
Joshua and the leaders relaxed believing no one could stop their crusade to conquer and inhibit the Promised Land.
Joshua 9: 3-6, “But the people of Gibeon, who were Hivites, heard what Joshua had done to Jericho and Ai, and they decided to deceive him. They went and got some food and loaded their donkeys with worn-out sacks and patched-up wineskins. They put on ragged clothes and worn-out sandals that had been mended. The bread they took with them was dry and moldy. Then they went to the camp at Gilgal and said to Joshua and the men of Israel, ‘We have come from a distant land. We want you to make a treaty with us.’”
Joshua and the leaders were convinced they were telling the truth and they made a covenant of peace with them without consulting God. Three days later Joshua was stunned to find out that the Gibeonites actually lived near them.
During the entire time Tori and I were fighting to hold onto our kids it seemed as though we were continually forced to stand alone. No one, including our attorneys, seemed to care whether or not we would receive justice or what was in the best interest of our children.
Tori and I were constantly on our knees begging God to help us overcome all of these obstacles. God quieted our fears and He gave us supernatural strength. No matter how bad it got, God gave us the courage to not give in and to never give up.
So many times I asked God, if He made us like this, then why was the church and society so against us? God profoundly stated that the church has been deceived. Many churches were not following Him they were following Satan.
As a child I was taught that some church doctrines were wrong, but I didn’t know that every church of every domination could be infiltrated and held captive by the serpent of hell. I thought that confessing that Jesus was the Son of God indicated that all were God’s. Now I knew from what was happening to Tori and I that many churches were evil.
2 Peter 2: 1&2, “False prophets appeared in the past among the people, and in the same way false teachers will appear among you. They will bring in destructive, untrue doctrines, and will deny the Master who redeemed them, and so they will bring upon themselves sudden destruction. Even so, many will follow their immoral ways; and because of what they do, others will speak evil of the Way of truth.”
Years later this became clear to me when my own son became a Southern Baptist minister. The Southern Baptist have over the years been known to reject homosexuals.
I sat in my son’s living room telling him about the game of life and how the spiritual world interacts in each person’s life. I explained how love is a sign of God and how Satan promotes **** as a means to destroy people.
I affirmed everything I had learned from my studies indicating that homosexuality had been around since the very beginning before the Law’s of Moses ever existed. That it was a created lifestyle. I also stated that I was not Jewish and I am a child of grace, thus making any Laws written against homosexuality null and void.
He stated that the clergy who are leaders in the Southern Baptist Convention have given all churches the freedom to make up their own minds as to whether or not gays should be accepted. I was surprised and stunned at his words for this was a little known fact. If this is true why are families turning their backs on their children, parents, and friends?
Quickly my thoughts of shock brought me back to God’s statement that not all churches were following Him. Clearly the clergy were involved in a huge cover up.
1John 2: 9-11, “Whoever says that he is in the light, yet hates his brother, is in the darkness to this very hour. Whoever loves his brother lives in the light, and so there is nothing in him that will cause someone else to sin. But whoever hates his brother is in the darkness; he walks in it and does not know where he is going, because the darkness has made him blind.”
Holding tightly to God has helped me see the truth about the church. Many churches are the Anti-Christ. They are against Jesus Christ’s message of love and grace.
Christ came to open the eyes of those who are blind and to help them see that this world is not what it seems. We are not here to live a good life. We are here to do battle for either the side of God or the side of Satan.
This world is a battle ground where clouds of deceit brought on by the lies of Satan often corrupt even those who are following God. This is the very reason why the Holy Spirit had to be sent to Jesus’ followers.
Today we have been given the freedom to worship Christ within the temple of our own bodies. We are taught in our hearts and our minds how to love. Because we are not subject to the Laws, we can overcome the corrupt teaching of those in authority over the church.
This is the reason why people are leaving the churches. They are seeing the inconsistencies and understanding that the clergy are teaching them wrong!
Joshua’s promise to the Gibeonites forced him to not destroy their country. His promise was in complete opposition to God’s will, yet according to the Law they had to keep their word or they would be subject to destruction.
Joshua’s solution was to force the Gibeonites into slavery. In later years Satan would use these people to corrupt the lives of the Israelites. They would intermarry and bring in false gods who would lead them away from the Laws of Moses and into a life separate from God.

Dating sites have been around since the beginning of the internet and it’s no small wonder that they have become one of the most viewed websites on the internet on a daily basis. Their popularity is a testament to those who have used these dating sites and recommended them to their friends and families.
As many as 1 in 5 of us have used a dating site at some point. Many around the world have trusted these sites and with good reason too. However, saying that all dating sites can be trusted would not be wise. There is fraud and danger everywhere in the world and the internet is no exception.
How can you trust the dating site you wish to join? You need to look at the site and ask your self if this website looks professionally made or is it clumsily put together, but remember that appearances can be deceiving so do not put too much faith in just how the site appears. Next, you will need to view the contact page and see if there is an actual physical address listed for the company and not some P.O. box. Also keep an eye out for landline contact numbers and not mobile numbers. Make sure that it is in fact a real company and not just some individual who has access to your details.
You can also check the security of the website by the page you go to when you wish to pay. This page should be encrypted. If it is encrypted then you will see
https://www in the address bar, notice the ‘s’ after the http. You may also notice a small padlock symbol on the bottom right of the internet page. This all signifies that this page you are entering your credit card information on is encrypted. Be sure to check the company that is handling payment, which could be Paypal, Netbanx, Nochex, etc.
Checking the search functions on a dating site is very important. You can see how many members there are on the website but also can view the profiles and see just what type of people are joining this site. Are they professional, young, older, from overseas, etc. When you do join one of these dating sites, becareful as there are many fraudulent members out there who fool even dating website owners. These bogus members are there to trick you into giving them details online, or even to meet them overseas from the country they are from. This can be very dangerous. Keep clear of those that are from countries other than yours.
To see how long the website has been running for visit this page:
http://www.archive.org, and fill in the section called ‘wayback machine’ with the dating sites website address. If the website had been running for a number of years then it would appear that it has to be at least somewhat successful and would prove it was not a fly by night website.

Michael Challiner asked:
In his spring Budget the Chancellor Gordon Brown announced swinging measures to tackle the use of Trusts being used to avoid Inheritance Tax. The immediate reaction amongst the financial and legal fraternity amounted to panic and confusion. Within ten days of the budget speech the estimates of the numbers of people that could be hit by the new anti-trust provisions hit 4.5 million.
Then, following the publication of the draft Finance Bill, the estimates fell to 1 million people. So, with specific reference to life insurance policies written in trust, what’s happening?
Well firstly before we go any further, we have to make the point that this article is commentating on the position based on the first draft of the Finance Bill – and it’ll be early July 2006 before that bill becomes law. As I write, the legislation still has to pass through parliament and it’s possible that the situation could change yet again. If it does I will keep you informed.
Within weeks of the budget speech, the Government retreated from its previously held position that all life policies written in trust are caught by the new legislation. The current position is that if your life insurance policy was written in trust before budget day 2006, then the money in the trust remains totally free of tax and fees. The legislation is not now to be retrospective. That’s one headache dispensed with.
However, if your policy was written in trust after the Spring Budget Day in 2006, then the new tax rules do apply.
For most people, the purpose of writing a life insurance policy in trust is to ensure that the policy pays out quickly and directly to where you want the money to go – often to a mortgage provider to repay the mortgage or to beneficiaries in the family to allow them to spend straight away as they like and tax free. These trusts that break upon death, are not now affected by the new regulations. That’s because only trusts that continue to hold money after the policyholders’ death are targeted by the new rules.
New life insurance policies written in trust will now be caught by a tax charge if the policy’s payout makes the deceased’s estate exceed the Inheritance Tax Threshold (IHT) of £285,000 and the policy is written in a type of trust known as an “interest-in-possession” trust.
Interest-in-possession trusts have been used to hold and invest the money paid out from a life insurance policy and pay the trust’s income to the spouse. The capital then passes to the children on the death of the spouse. Following the budget, these arrangements will be subject to a 40% IHT charge when then money passes into the trust for your spouse – plus a 6% tax charge every ten years and an “exit fee”. These taxes can be avoided if the you give your spouse significant control over the trust, which many people may perhaps not want to do especially if they are in a second marriage with children from previous relationships. The alternative is to use a bare trust as this type of trust is not caught by the new regulations. However, if you do use a bare trust, the money automatically goes to your children when they reach the age of 18.
If you are buying a new life insurance policy and want to use it to pay off a mortgage or provide immediate money for your family if you were to die, then you should still consider writing our policy in trust. However, it becomes more important than ever to buy the policy through a broker who is fully versed in the current requirements for trusts and can ensure you get exactly the type of trust you need.

Aspasia asked:
It cannot be said enough that trust is the anchor in any and every relationship that we maintain in our lives. The said relationship may manifest in the form of a friendship, business, family or even love – whatever it might be, the most fundamental aspect to that relationship has to be trust in and respect for each other. You must understand that, for any relationship to work out and blossom further, you have to constantly work at maintaining and strengthening that ‘trust’ factor.
Any relationship finally breaks down if there is extreme lack of trust in it. No matter how hard you try, that bond will never be able to flourish completely without both parties perfectly understanding and accepting each other’s motives. Not placing enough trust means that there exists a lot of worry and doubt in that association
Of course, it sometimes gets difficult to totally trust someone, especially if you have been hurt in some way in a past relationship of some kind. So how do you unlearn your conditioning from all those previous unfortunate experiences and learn to get back that trusting quality you once possessed?
Accept and trust yourself
To unlearn all the negative patterns of thought you have developed through the years, you have to first learn to let go of the past. Forgive yourself and others for all mistakes committed and all the misunderstandings that have come in the way. Acknowledge your mistakes and accept yourself for what you are. All of us have our negatives, some which we simply have to learn to live with.
Learn to trust yourself and your own capabilities. You will only be able to shed your distrusting attitude if you first learn to accept, trust and love yourself. Remember, the macro is the micro. The external world, for us, is only a manifestation of our internal selves. If we continue to be positive, we will have positive experiences in our own lives.
Learn to let go
Learning to let go is a major step towards shedding that over-watchful attitude of yours. This step is most essential if you are experiencing an alarming amount of turbulence in your relationship with your partner or spouse. It happens very often that small day-to-day skirmishes over some truly silly reasons finally snowball out of all proportion and create an irreparable rift between both parties concerned.
Learn to take it easy and talk with the person concerned and express your feelings and thoughts openly. Also, do not keep an “account” of anything. Let the bygones be bygones – leave alone the past and focus on building a better tomorrow with your relationship.
Of course, it has to be noted here that a relationship just will not work out right if one is trying to take undue advantage of the other. If you are being the victim in such a situation, the only way out for you would be to discontinue meeting that particular person and walk out of that relationship altogether.
In conclusion, you should understand that any relationship never completely works out unless there is a complete, 100% trust between both you and the other person involved. So learn to stop doubting people’s motives and learn to place trust in each and every one of your relationships, starting today!

Sandeep Varma asked:
If you currently have a trust, or are thinking of setting one up, this checklist from my book, The 7 Biggest Mistakes Trustees Make and How to Avoid Them, will show you what the most common and serious mistakes are and how to avoid them.
Each one of these seven mistakes has the potential to ruin your financial plans and to turn family members against each other. Here they are in brief:
Mistake #1 – Failure to Communicate: Failing to communicate properly with all the parties involved with the trust is, perhaps, the biggest mistake trustees make. From my experience, parents must deal with three important predicaments before considering advanced planning:
Do we have enough money to last the rest of our lives?
Do I want my spouse to know all the financial details of the estate?
Do we want our children to know all the financial details of the estate?
I have also found that once planning takes place, children must also deal with two common reservations:
1. I don’t feel I should interfere with my parents’ finances.
2. If I take an interest, will I be perceived as being greedy?
Through my experience, families that avoid mistake #1 have a foundation that is able to withstand almost any type of problem in the future.
Mistake #2 – Failure to Hire the Appropriate Advisors: Estate planning is a growing sector that is becoming more complex with its constant changes. Every year laws are revised and added. It’s important that when it comes to making important financial decisions that you consult professional advice from a team made up of: attorneys, accountants, and financial planners.
Mistake #3 – Failure to Follow the UPIA: This mistake is more legal in nature than the previous two. It involves the UPIA, or, more specifically, the lack of knowledge of it. UPIA stands for Uniform Prudent Investor Act. Do not ignore this new law! Ignoring this law increases your chances of being sued. It provides an easy way for a disgruntled heir and a slick lawyer to prove that a trustee is unfit to manage the trust, and owes significant amounts of their personal money back to the trust.
Mistake #4 – Failure to Follow the Terms of the Trust: The most important part of estate planning is the trust. The trust is something that should not be taken lightly. It must be well thought out and written to express your exact desires. There can be no ambiguity in a trust. There can also be no assumption that your heirs will know what your intentions are. You must be as specific as possible when writing this document.
Mistake #5 – Failure to Minimize Liability and Risk: The trustee has many duties and responsibilities to the beneficiaries. The trustee is the protector of the assets. He is responsible for not only maintaining the current level of investments, but also ensuring that the investment will grow at a reasonable rate of return over the years. When planning for future finances that involve minimizing liability and risk, there are three areas to be considered: long-term sickness, taxes, and general lack of knowledge.
Mistake #6 – Failure to Review Regularly: A common mistake among trustees is the failure to review the trust regularly. Your life changes over time. So it is necessary to keep on top of these changes. The review process is divided into three critical areas: investment strategy, trust assets, and advisors.
Mistake #7 – Failure to Treat it like a Business: As a trustee, you need to think of yourself as a manager. You have a finite number of assets to manage, and your long-term goal is to make them grow. This is your business. Separate yourself from the beneficiaries, even if you are one. Think of them as shareholders, and it is your job to maximize profits without taking on too much risk.
You are accountable to the beneficiaries for your actions. It is your job to protect yourself and do the best job possible. You are taking on a great liability, so you need to make sure you get good advice.
There are many decisions that need to be made over the life of the trust, many which are not pleasant to make. Some even have absolutely nothing to do with assets or money. Yet, they must be faced. The more aware you are of the potential problems, the better trustee you will become.
